Mitigating circumstances

We can advise you on submitting mitigating circumstances if you are experiencing personal or medical issues which are impacting on your academic work. TEDI-London defines Mitigating Circumstances as “circumstances which are sudden, unexpected, significantly disruptive and beyond your control which affect your performance at assessment”. The circumstances should be affecting you around the time of the assessment or during the period when you were revising for it/working on it.

Mitigating Circumstances may prevent you from attending an assessment, mean you need extra time to complete it, mean you need to defer it (push it back to the next assessment period) or affect your performance in the assessment.

TEDI-London’s policy is that if mitigating circumstances are affecting you and would negatively impact on your performance, then you should not submit/sit an assessment and should instead submit a Mitigating Circumstances Form.

We can advise you on whether your circumstances would meet the TEDI-London definition of mitigating circumstances, check your mitigating circumstances form for you before you submit it and advise on what evidence would be needed. Mitigating Circumstances Forms must be submitted *no later than 10 working days* after your assessment date/submission deadline.

Appeals

If you receive a result that you wish to appeal, we can advise you on submitting an appeal *within 10 working days* of receiving your result. We can advise you on whether your case meets either of the grounds:

  • That there was a significant and relevant administrative error (which could have been in the way your assessment was carried out, the way your result was considered by an Assessment Board, how a mitigating circumstances claim you made was processed or in the way an accusation of academic dishonesty was handled for example)
  • That you were experiencing mitigating circumstances at the time of the assessment which were unknown to the Assessment Board and which you were unable to disclose for a valid reason

We can check your appeal for you before you submit it, and advise on what evidence you need to provide in order to meet the grounds above.

If you are unhappy with the outcome of your appeal, we can advise you on the process of submitting an appeal review *within 10 working days* of the outcome and if this is unsuccessful we can support you to take your case to the Ombudsman for Higher Education, the Office of the Independent Adjudicator, within *one year* of the official letter completing TEDI-London’s internal procedures.

TEDI-London does not allow appeals when a student has passed an assessment but wants to be reassessed to gain a higher grade.

Complaints

We hope you will have a pleasant experience at TEDI-London and don’t need to make a complaint about your experience, but if you do encounter any issues and need any support, we can offer advice on the complaints process. We can support you to complain about any aspect of your course and/or TEDI-London services or about a staff member or fellow student.

  • We can support you to find the right person to direct an informal complaint to, and advise you on how to approach making an informal complaint and what outcomes may be possible.
  • If you’re not satisfied with the outcome of your informal complaint, we can support you to submit a formal complaint form *within 20 working days* of the date of the incident/issue about which you are complaining.
  • If you’re not happy with the outcome of a formal complaint, we can advise you on submitting a complaint review form within *10 working days* of receipt of the formal complaint outcome.
  • If your complaint review doesn’t provide you with the outcome you’re looking for, we can support you to take your case to the Ombudsman for Higher Education, the Office of the Independent Adjudicator, within *one year* of the official letter completing TEDI-London’s internal procedures.

Academic Integrity or Disciplinary Allegation

If you are informed that there is a suspected issue with academic dishonesty in your work (this can include poor academic performance, plagiarism, collusion, copying, falsifying data or using essay mills/cheating websites) or informed there is a potential case of misconduct falling under the Student Discipline policy, we can also advise you on this and support you through the process.

We can support you through the preliminary investigation, advise you on submitting a statement and evidence if you are required to do so and support you in making an appeal or taking the case to the Ombudsman for Higher Education, the Office of the Independent Adjudicator, if you are unhappy with the outcome.

We can offer accompaniment to meetings and formal panel hearings which are online. Subject to availability we may be able to offer accompaniment to formal panel hearings in person but this is not guaranteed.
